By downloading, installing, or using Littlebird ('the Service' or 'the App'), you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not use our service.
Littlebird is an AI assistant application that helps users manage tasks, projects, and information through screen monitoring and interaction analysis.
3.1 : You must create an account to use Littlebird.
3.2 : You are responsible for maintaining the confidentiality of your account credentials.
3.3 : You must provide accurate and complete information when creating your account.
3.4 : You are responsible for all activities that occur under your account
You agree not to, and not permit others to:
a) Use the App for any illegal purposes.
b) Attempt to gain unauthorized access to the App or its systems.
c) Interfere with or disrupt the App's functionality.
d) Distribute malware or other harmful code.
e) Reverse engineer or attempt to extract the source code.
f) Use the App to collect sensitive information without authorization
g) Use the service in any manner that could damage, disable, overburden, or impair the service or interfere with any other party's use of the service. This includes, but is not limited to, sending an excessive number of queries or using the service in a way that consumes a disproportionate amount of system resources, as determined by us in our sole discretion.
h) Use any automated means, such as bots, scripts, or scrapers, to access or interact with the service in a way that is not explicitly permitted by us.
"Protected Health Information" (PHI) has the meaning given under the Health Insurance Portability and Accountability Act and its implementing regulations, as amended ('HIPAA'). You may not put PHI into Littlebird unless you have a Business Associate Agreement (BAA) with us that is currently in effect. A BAA is available on request within the settings section of the Littlebird app for Mac and Windows; paying for a plan does not by itself put a BAA in effect. Where a BAA is in effect, our obligations apply only to the features and configurations identified in it. All accounts without a BAA in effect, including all free accounts, are not authorized for PHI, and putting PHI into such an account is a material breach of these Terms. You are responsible for determining what counts as PHI and for your own HIPAA obligations.
5.1. Littlebird and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws.
5.2. You may not copy, modify, distribute, sell, or lease any part of our services or included software.
6.1. You retain ownership of any content you create or upload to the App.
6.2. You grant Littlebird a license to use, store, and process your content for the purpose of providing and improving our services.
6.3. The license in Section 6.2 is subject to Section 4A. Where a BAA is in effect, its terms control over Section 6.2 for any PHI.
7.1. Some features may require a paid subscription.
7.2. All purchases are final and non-refundable, except as required by law.
7.3. Subscription fees may change upon notice.
7.4. Cancellation of subscription must be done through your account.
8.1. Littlebird is provided "as is" without any warranties.
8.2. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
8.3. Our total liability shall not exceed the amount you paid for the service in the past 12 months.
9.1. We reserve the right to modify or discontinue the service at any time.
9.2. We will provide reasonable notice of any material changes.
10.1. We may terminate or suspend your account at any time for violations of these terms. Without limiting the foregoing, we reserve the right to suspend or terminate your account without notice if we believe, in our sole discretion, that (a) your use of the service is excessive or imposes an unreasonable or disproportionately large load on our infrastructure, or (b) you are handling PHI on an account without a BAA in effect (see Section 4A).
10.2. You may terminate your account at any time through the App settings.
10.3. Upon termination, your right to use the App will immediately cease.
You agree to indemnify and hold Littlebird harmless from any claims resulting from your use of the service or violation of these terms. This includes any claims arising from your handling of Protected Health Information in violation of Section 4A.
12.1. The App may integrate with third-party services.
12.2. Use of third-party services is subject to their respective terms and conditions.
12.3. We are not responsible for third-party services.
These Terms shall be governed by the laws of the State of Delaware, without regard to its conflict of law provisions.
14.1. We reserve the right to modify these terms at any time.
14.2. We will notify you of any material changes via email or in-app notification.
14.3. Continued use of the App after changes constitutes acceptance of new terms.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect.
